Welcome to EduCreate Academy. These Terms of Service constitute a legally binding agreement between you and EduCreate Academy governing your access to and use of the educreate-academy.com website, including any subdomains, mobile applications, learning management systems, digital content, course materials, community forums, and all related services offered through our platform.

By accessing, browsing, registering for an account, enrolling in a course, submitting a payment, or otherwise using any part of the EduCreate Academy platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety. If you do not agree with any portion of these terms, you must immediately cease all use of the platform and refrain from accessing any of our services.

Acceptance of Terms and Eligibility

By using the EduCreate Academy platform, you represent and warrant that you are at least eighteen years of age or have obtained verifiable consent from a parent or legal guardian. The platform is intended for use by individuals who can form legally binding contracts under applicable law. If you are accessing the platform on behalf of a company, organization, or other legal entity, you represent and warrant that you have the full authority to bind that entity to these Terms of Service. In such cases, references to "you" and "your" shall refer to both you as an individual and the entity you represent.

EduCreate Academy reserves the right to refuse service, terminate accounts, remove or edit content, or cancel enrollments at its sole discretion at any time and for any reason, including but not limited to violation of these Terms of Service, fraudulent activity, chargeback abuse, or any conduct that EduCreate Academy deems harmful to the platform, its instructors, or its community members.

Account Registration and Security

To access certain features of the platform, including course enrollment, community participation, and certificate issuance, you must create an account by providing accurate, current, and complete information, including a valid email address, your legal first and last name, and any other details requested during the registration process. You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to accept full responsibility for all activities that occur under your account, whether authorized by you or not.

You must notify EduCreate Academy immediately upon becoming aware of any unauthorized use of your account, any breach of security, or any other compromise of your credentials. EduCreate Academy shall not be liable for any loss or damage arising from your failure to comply with these account security obligations. Sharing account credentials with third parties, reselling access to courses, or facilitating unauthorized access to paid content is strictly prohibited and constitutes a material breach of these Terms of Service.

EduCreate Academy reserves the right to suspend or terminate any account that provides false, misleading, or incomplete information during registration, or any account that remains inactive for a continuous period of twelve months without any course enrollment or login activity.

Course Enrollment, Access, and Licensing

When you enroll in a course on EduCreate Academy, you are granted a limited, non-exclusive, non-transferable, revocable license to access and view the course content for your personal, non-commercial educational purposes. This license does not grant you any ownership rights over the course materials. All course content, including but not limited to video lectures, written materials, downloadable templates, quizzes, assignments, code samples, design assets, and any supplementary resources, remains the exclusive intellectual property of EduCreate Academy and its instructor partners.

You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, create derivative works from, sublicense, or otherwise transfer or use any course content except as expressly permitted by these Terms of Service. Specifically prohibited activities include, but are not limited to, recording or screen-capturing video lectures, downloading and re-uploading course files to third-party platforms, sharing your account login details with others, and embedding course content into other websites or learning management systems without prior written authorization from EduCreate Academy.

Course access durations vary depending on the type of purchase. Single-course purchases include lifetime access, defined as the lifetime of the course on the EduCreate Academy platform. Bundle purchases include access for a period of twelve months from the date of purchase, unless otherwise stated at the time of enrollment. Monthly premium membership subscriptions provide unlimited access to all courses for the duration of the active membership period. EduCreate Academy reserves the right to retire, update, or replace course content at any time to maintain relevance and quality.

Payments, Pricing, and Billing

All prices displayed on the EduCreate Academy platform are stated in United States Dollars unless otherwise explicitly noted. Prices are subject to change at any time without prior notice; however, price changes will not affect enrollments that have already been confirmed and paid for in full. You agree to pay all fees and applicable taxes associated with your chosen enrollment or subscription plan at the rates in effect at the time of purchase.

For one-time course purchases and bundle purchases, payment is due in full at the time of enrollment. For monthly premium membership subscriptions, your payment method on file will be charged automatically on a recurring monthly basis on the anniversary date of your initial subscription. You authorize EduCreate Academy to store your payment method information and to charge the applicable recurring fee each billing period until you cancel your subscription. It is your responsibility to ensure that your payment method information remains current and valid. Failed subscription payments may result in immediate suspension of access until the outstanding balance is resolved.

EduCreate Academy uses third-party payment processors to handle all financial transactions. We do not store full credit card numbers or sensitive payment details on our servers. You agree that EduCreate Academy is not responsible for any errors, delays, or failures in payment processing caused by third-party payment providers.

Refund and Cancellation Policy

EduCreate Academy maintains a comprehensive Refund Policy that governs all refund requests, cancellations, and dispute resolution procedures. The full Refund Policy is published as a separate document on our website and is incorporated into these Terms of Service by reference. By agreeing to these Terms of Service, you acknowledge that you have read and agree to the terms of the Refund Policy. In the event of any conflict between the refund provisions in these Terms of Service and the standalone Refund Policy document, the Refund Policy shall govern.

A summary of key refund terms includes: single-course purchases are eligible for a full refund within thirty calendar days of purchase provided that less than twenty-five percent of the course content has been accessed or completed. Bundle purchases are eligible for a full refund within thirty calendar days provided that no individual course within the bundle has been completed in full and no completion certificate has been issued. Monthly membership fees are non-refundable for the current billing period, but you may cancel your subscription at any time to prevent future charges.

Intellectual Property Rights

The EduCreate Academy platform, including all content, features, functionality, software, design elements, text, graphics, logos, icons, images, audio clips, video recordings, digital downloads, data compilations, and the selection and arrangement thereof, is the exclusive property of EduCreate Academy, its licensors, or its content suppliers and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The EduCreate Academy name, the EduCreate Academy logo, the "Career Architecture" tagline, course codes, and all related branding elements are trademarks or registered trademarks of EduCreate Academy. You may not use, reproduce, or display these marks without prior written permission. Any unauthorized use of the intellectual property of EduCreate Academy may result in legal action, including claims for damages, injunctive relief, and recovery of legal fees.

User-Generated Content and Community Guidelines

The EduCreate Academy platform may include community forums, discussion boards, peer review features, and other interactive areas where users may post, submit, or share content, including text, comments, questions, code snippets, project submissions, and other materials. By posting content to the platform, you grant EduCreate Academy a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and improving the platform.

You are solely responsible for the content you post. You agree not to post any content that is unlawful, defamatory, harassing, threatening, abusive, obscene, pornographic, invasive of privacy, or otherwise objectionable. You may not post content that infringes on the intellectual property rights of others, contains viruses or malicious code, or constitutes unsolicited advertising or spam. EduCreate Academy reserves the right, but assumes no obligation, to monitor, review, edit, or remove any user-generated content at its sole discretion and without prior notice.

Violation of community guidelines may result in immediate suspension or termination of your account, removal of your content, and a permanent ban from the platform. EduCreate Academy fully cooperates with law enforcement authorities in investigating any alleged illegal activity on the platform.

Limitation of Liability

To the fullest extent permitted by applicable law, EduCreate Academy, its officers, directors, employees, instructors, affiliates, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, business interruption, or other intangible losses, arising out of or in connection with your use of or inability to use the platform, any course content, or any services provided through the platform.

EduCreate Academy's total aggregate liability for any claims arising under these Terms of Service, whether in contract, tort, negligence, strict liability, or any other legal theory, shall not exceed the total amount paid by you to EduCreate Academy during the twelve-month period immediately preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

Disclaimer of Warranties

The EduCreate Academy platform and all course content are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. EduCreate Academy expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing or usage of trade.

EduCreate Academy does not warrant that the platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components. EduCreate Academy does not guarantee any specific results, career outcomes, employment opportunities, salary increases, promotions, or professional advancement as a result of completing any course or program offered on the platform. Educational content is provided for informational purposes only and does not constitute professional advice.

Indemnification

You agree to indemnify, defend, and hold harmless EduCreate Academy, its officers, directors, employees, instructors, affiliates, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees, including reasonable attorneys' fees, arising out of or related to your violation of these Terms of Service, your use of the platform, your user-generated content, your violation of any third-party rights, or your infringement of any intellectual property or other right of any person or entity.

Dispute Resolution and Governing Law

These Terms of Service and any disputes arising out of or relating to your use of the EduCreate Academy platform shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States of America, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or related to these Terms of Service shall be instituted exclusively in the federal or state courts located in Franklin County, Kentucky.

Before initiating any formal legal action, you agree to first contact EduCreate Academy directly and attempt to resolve the dispute informally through good-faith negotiation for a period of at least sixty days. If the dispute cannot be resolved informally, both parties agree to submit the dispute to binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, with the arbitration to take place in Frankfort, Kentucky. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

Modifications to Terms

EduCreate Academy reserves the right to modify, amend, or replace these Terms of Service at any time. Material changes will be communicated to registered users via email to the address associated with their account and through a prominent notice on the platform at least thirty days before the changes take effect. Non-material changes, including but not limited to clarifications, typographical corrections, and formatting adjustments, may take effect immediately upon posting.

Your continued use of the EduCreate Academy platform after any modifications to these Terms of Service shall constitute your acceptance of the revised terms. If you do not agree with the modified terms, you must discontinue your use of the platform and may request termination of your account. Any courses purchased prior to the modification of terms will continue to be governed by the terms in effect at the time of purchase.

Severability and Waiver

If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms of Service shall otherwise remain in full force and effect and enforceable. The failure of EduCreate Academy to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of that right or provision. No waiver of any term or condition shall be deemed a further or continuing waiver of such term or condition.

Entire Agreement

These Terms of Service, together with the Privacy Policy, Refund Policy, and any other legal notices or policies published on the EduCreate Academy platform, constitute the entire agreement between you and EduCreate Academy concerning the subject matter hereof and supersede all prior or contemporaneous communications, agreements, and understandings, whether oral or written, between you and EduCreate Academy.
